中国专利申请人可直接申请外国专利 Chinese Entity or Individual Shall File Directly An Application For Patent in A Foreign Country

Abstract: Where any Chinese entity or individual intends to file an application in a foreign country for a patent for its or his domestic invention-creation, it or he shall file directly an application for patent with the foreign administrative organ. It is required to be kept secret according to the related regulations in China.

全国人大常委会2008年12月27日表决通过的关于修改《中华人民共和国专利法》的决定，删除了现行专利法关于向外国申请专利须先申请中国专利的规定，规定申请人可直接申请外国专利，但必须遵守中国的有关保密制度。
修改后的专利法同时规定，在中国没有经常居所或者营业所的外国人、外国企业或外国其他组织在中国申请专利和办理其他专利事务的，应当委托依法设立的专利代理机构办理；中国单位或个人在国内申请专利和办理其他专利事务的，可以委托依法设立的专利代理机构办理。
